Article 63 of the *Tax Collection and Administration Law* states very clearly:Tax evasion occurs when a taxpayer, after being notified by the tax authorities to file a tax return, refuses to do so and fails to pay or underpay the taxes due.
Unpaid or underpaid taxes must be collected, along with late payment penalties; fines ranging from 0.5 to 5 times the amount owed may be imposed, and criminal liability may be pursued if the act constitutes a crime.
“Failing to file a return despite being notified to do so” and “voluntarily filing a late return” are entirely different in nature!
