80% Seller Misses $127 Million in Tariff Refunds! Just for not doing CBP e-registration - is your money still there?

U.S. Treasury Secretary Besant just made an announcement:

Import duties previously found to be illegally levied are now allowing importers to claim refunds. There are already about

$127 million The refund requests are in the processing stage and funds are being disbursed.

Sounds like good news, right?

But--

🔴 There is one number that completely cools most sellers off:

Of the approximately 300,000 businesses that are eligible, only about20%Completed electronic payment enrollment.

That is to say:80%of eligible businesses will not receive any refunds because they have not completed their CBP (U.S. Customs and Border Protection) electronic payment registration.

It's not a lack of qualifications, it's not a failure of vetting--

01 The money's coming in.

Refunded to: the importer (IOR, Importer of Record) who actually paid the tariffs deemed ”illegal” at the time.

For cross-border sellers, this means:

  • Native American companies that pay taxes directly as importers → Eligible for refund
  • Imported on behalf of a third party through a freight forwarder/customs broker → more complex in practice
  • FOB export, customs clearance by buyer → Refunds are on the buyer's side and need to be negotiated.
  • Double Clearance Tax Package (DCTP) model → Refunds are in the hands of the service provider, making recovery difficult

02 Why aren't the 80%'s registered?

Many sellers think this way:

“I'll wait and see when the policy becomes clear.”

“It's not a lot of money anyway, it's not worth getting a dedicated registration process.”

“I don't know what to register for.”

The result is - the policy is in place, the money is going out the door, and they're not on the list.

Electronic payment enrollment in the CBP Tax Refund System requires importers to complete the following steps:

  1. Complete registration in the CBP system to tie up a compliant U.S. bank account
  2. Provide the corresponding import record (Entry Number)
  3. Refund notification will be received only after the material has been reviewed and approved

Without completing the registration, you are not even found as a person in the system and naturally the money will not be credited to you.

03 Is it too late?

It's not too late, but it's important to act now.

The Ministry of Finance has stated that refunds will be disbursed ”according to the progress of customs audits” and has not said that the application window has been closed. However, a few points need to be made clear:

  • Disbursements have begun = First to register, first to process, later to queue up
  • There is a cycle of review, the later you register = The longer you wait.
  • Incomplete or incorrectly formatted material = Being returned to re-queue

Every day you drag it out, the line gets a few more people stuck in front of you.

04 How much can you refund?

There is no uniform answer and it depends on three variables:

Variable 1: How much tariff you paid

Specific amount = value of imported goods at the time × tariff rate found to be illegal × your actual import volume

Variable 2: Your mode of importation

Owned U.S. company as IOR → Full refund rights are most clear
Freight forwarder/third-party IOR → Confirmation through freight forwarder required
FOB mode → Right of refund is with the overseas buyer

Variable 3: Material integrity

The more complete the Entry Number, the higher the approval rate.

If the amount of duty you are paying at that time is more than100,000 RMB, this refund is worth pursuing seriously.

Because there is no U.S. domestic company, you cannot use your own name as the IOR when importing, resulting in the right to refund being in the hands of the freight forwarder or buyer, making it extremely difficult to recover.
