The Second Hurdle (Core): The company has a substantive economic presence in Hong Kong. This is determined by four specific criteria: whether it has office space, whether it employs local staff, where management decisions are made, and whether business activities take place in Hong Kong.
The third requirement: The company must not be merely a conduit; it cannot be a channel that simply “receives money and passes it on.”
The Fourth Hurdle: The company has a track record of continuous operations, maintains accounting records that have been audited, and engages in normal business activities.
