When many cross-border e-commerce business owners receive their first registered letter from the tax authorities, they’re completely taken aback:
“Why would the tax office be after me?” ”Did someone report me?” ”Am I going to jail?”
Then the first thought that popped into my head was, ”I need to shut down the company right away.”
If you feel the same way,Please stop for a moment.

PART
Let's get this straight: What exactly is this notification letter?

The ”Tax Notice” is one of the most commonly used legal documents issued by the tax authority. It does not necessarily mean that you are being ”audited,” nor does it necessarily mean that you will be “fined.” It could be:
Receiving a notice ≠ having been penalized. In many cases, the notice itself is simply an opportunity for you to ”correct the issue on your own.”
Typical scenarios in which cross-border e-commerce sellers receive this type of notice
Scenario 1: There is a clear discrepancy between the account transaction history and the reported income, causing the system to automatically trigger a tax assessment.
Scenario 2: Being Dragged Into a Case Involving an Upstream Supplier (Upstream supplier investigated for issuing fraudulent invoices; downstream buyer asked to cooperate with the investigation)
Scenario 3: Being Selected for a Tax Spot Check or Special Audit
Scenario 4: An anomaly in a personal account’s incoming payments is detected by big data screening
Regardless of the situation, the notification will specify three things:What you are supposed to do, when it must be completed, and the consequences of not doing it.

PART
The No. 1 Thing You Must Never Do: Dissolve Your Company

The first reaction of many business owners is: ”I’d better dissolve the company right away—that way, the tax authorities won’t be able to track me down.”
This is the biggest misconception.
Before a company can be dissolved, it must first complete tax settlement and obtain a “Tax Clearance Certificate” from the tax authorities.
If a company has any unresolved audits, unreported tax returns, or unpaid taxes in the tax system, the tax authority will not allow you to deregister the company.
When you submit a deregistration application, the system immediately displays a pop-up window stating: ”This taxpayer has an outstanding tax audit case; the deregistration application cannot be accepted.”
What’s more serious is that once a tax audit has been initiated, attempting to deregister your business at that point will be deemed ”evading a tax audit.” This constitutes ”evading, refusing, or otherwise obstructing a tax authority’s audit” as defined in Article 70 of the *Tax Collection and Administration Law*, and you may face a fine of between 10,000 and 50,000 yuan.
If the amount involved is substantial, the tax authorities may refer the case to the police, which could constitute the crime of tax evasion—This isn't just a matter of fines anymore.
Dissolving your company after receiving a notice will not only fail to resolve the ”problem,” but will also make matters worse.

PART
No. 2: What You Must Never Do—Destroy or Tamper with Records

Some business owners” second reaction upon receiving the notice is: ”Just tweak the ledgers a bit, delete some data—if they can’t find anything, we’ll be fine.”
This is the most dangerous thing to do.
Article 71 of the *Tax Collection and Administration Law* clearly stipulates:
“Any person who, in violation of the provisions of Article 22 of this Law, illegally prints, lends, resells, alters, or forges tax payment receipts shall be ordered by the tax authorities to rectify the violation and shall be fined not less than 2,000 yuan but not more than 10,000 yuan; where the circumstances are serious, the fine shall be not less than 10,000 yuan but not more than 50,000 yuan; where such acts constitute a crime, criminal liability shall be pursued in accordance with the law.”
Moving up one level,Article 201 (Tax Evasion) and Article 205 (Issuing False Special Value-Added Tax Invoices) of the Criminal Law are both serious crimes.
Real-Life Examples
After a cross-border e-commerce company in Shenzhen received a notice from the tax authority, its accountant, acting on the boss’s instructions, used software to alter the sales data for the previous two years and deleted some bank transaction records.
When tax authorities retrieved bank account data and discovered discrepancies between the recorded and actual balances, they referred the case to the police.
Ultimately, the company’s legal representative was found guilty of tax evasion and was required not only to pay more than 3 million in back taxes, late payment penalties, and fines,It also involves criminal liability.
The tax authority does not need your consent to access your bank statements.
Even if you change the data in the system, the bank transaction history retrieved by the tax authority cannot be altered.

PART
No. 3: What You Must Never Do—Ignore It and Put It Off

Some bosses” third reaction upon receiving the notice is: ”Just leave it for now; I'll deal with it when I have time."
This is the most common—yet most easily overlooked—mistake.
通知书上一定写着”限期 X 日内”。这个期限通常是 15 天、30 天。你不理它,系统自动计时。超期不回复,税务局可以:
For many people, it’s not that they ”deliberately ignore it”—it’s that ”they just leave it there and forget about it.” They sign for the package, toss the envelope on their desk, and don’t remember it until more than a month later. When they finally open it, they find the deadline has already passed.
What's more troublesome is:If you continue to fail to respond, the tax authority will deem you ”uncontactable” and proceed with public notice service—the notice is deemed served 30 days after publication, and subsequent procedures will proceed as usual.

The Right Way to Do It: A 4-Step Process
After receiving the notification, follow these steps in this order:
Step 1: Stay calm and read the notice carefully.
Make sure you understand these three things: What type of notice is it? What are you being asked to do? What is the deadline?
Step 2: Confirm the company’s current tax status
Log in to the Electronic Tax Bureau to view:
1. Are there any unreported tax types or periods?
2. Are there any unpaid taxes?
3. Is the company's tax status in good standing?
Step 3: Prepare the required documents according to the instructions in the notification letter
The admission letter will list the required documents. Please submit them exactly as listed—neither more nor fewer.
Step 4: Respond within the specified time frame
Self-correction:Submit a supplemental return or amend data on the Electronic Tax Bureau
Written feedback:Submit a statement of readiness and supporting documents via the Electronic Tax Bureau or at a tax service center.
After completing your response, keep all delivery records and acknowledgments of receipt. These records serve as crucial evidence in the event that further proof or an appeal is required.
Important Reminder:If the notice clearly states that it is a ”tax audit” document, or if the amount involved is significant or the circumstances are complex, it is not recommended to handle the matter on your own. Responses to tax audits are legally binding; once submitted, they are difficult to withdraw or amend. It is advisable to leave professional matters to professionals.

In Closing: A Comparison Chart of Three ”Instinctive Reactions”
When you receive a tax notice, the thing you fear most isn’t having to ”pay back taxes,” but having ”done something wrong.”
These three responses—dissolving the company, destroying the data, and doing nothing—are all ”instinctive reactions” people have when they’re panicking, not rational solutions.
The right attitude can be summed up in eight words: stay calm, don’t shy away, take it seriously, and handle it promptly.
