On August 18, 2025, the new EU battery law (EU 2023/1542) came into force in France and the old directive (2006/66/EC) was repealed simultaneously. The new regulation is centered on EPR (Extended Producer Responsibility), which requires the relevant parties to be responsible for the entire life cycle of the battery.

01 New rules for battery classification: breakdown from a single to five categories

Previously, the French battery registration only set up a "portable battery" category, the new rules will be refined into five categories, different categories correspond to different registration standards and recycling costs, need to be based on the actual use of the product to accurately determine:

:: Portable batteries

:: Industrial batteries

:: Light transportation batteries (LMT)

:: Electric vehicle batteries (EV)

:: Starting/lighting/ignition batteries (SLI)

02 Subjects of policy application: who are the "producers"?

The new regulations refer to a broad range of "producers" who are subject to compliance obligations under any of the following conditions:

:: Importers: first introduction of batteries or battery-containing products from non-EU countries into the EU market;

:: Manufacturers: first launch of a product or a single product with a battery embedded in it in the European Union;

:: Distributors/retailers: selling non-EU battery products directly to EU consumers or selling own-brand battery-related products;

:: Remote sellers: sales of batteries and battery-containing products to the French market by means of a non-physical operation, such as online;

:: Battery refurbishers: remanufacturing or refurbishing of batteries and putting them back into circulation.

✍Special note: If batteries are purchased and resold from a local French company that has completed EPR compliance, there is usually no "producer" responsibility, but verification that the supplier has legally complied with EPR-related obligations is required.

03 Judgment criteria for various types of batteries

✓ Portable batteries

The total weight in sealed condition does not exceed 5 kg, is not intended for industrial equipment, and does not fall into the category of electric vehicle batteries, LMT batteries, or SLI batteries.

✓ Light transportation batteries (LMT)Sealed batteries weighing up to 25 kilograms and designed to provide traction power for wheeled vehicles driven only by electric motors or by a combination of electric motors and human power, including vehicles of category L in accordance with the provisions of the European Union (EU) Regulation (EC) No. 168/2013 (43), and which are not dedicated to electric vehicles.

✓ Electric Vehicle Batteries (EV)Both types of situations are categorized as such:

● Batteries designed to provide traction power for hybrid or electric vehicles of category L in accordance with European Union Regulation (EU) No 168/2013 and weighing more than 25 kilograms;

● Batteries designed to provide traction power for hybrid or electric vehicles of category M, N or O in accordance with European Union Regulation (EU) No 2018/858.

✓ Starting/Lighting/Ignition Battery (SLI)

The core use is to power starting, lighting or ignition systems, and can also be used to power auxiliary functions in vehicles, other means of transportation or various types of equipment.

✓ Industrial batteries

:: Batteries specially designed or prepared for industrial use;

● Batteries weighing more than 5 kg that are not EV batteries, LMT batteries, or SLI batteries;

:: Exception: Even if the weight is less than 5 kg, if the battery is a nickel-cadmium battery or a lead-containing battery, it must be classified as an industrial battery (this type of battery is additionally subject to the Restriction of Hazardous Substances (RoHS) requirements of the EU RoHS Directive).

🙋 Quick Tips for Determination

● Batteries weighing less than 5 kg are usually categorized as portable batteries (exceptions: nickel-cadmium batteries and lead batteries are categorized as industrial batteries regardless of their weight);

● Batteries weighing ≥5kg and not belonging to EV, LMT or SLI categories are directly categorized as industrial batteries.

Battery Category 5 Standards at a Glance

Answers to high-frequency compliance questions

1) How are battery recycling costs accounted for?

The recycling fee is centered on an "Annual Base Fee", which is charged separately for each battery category and can be interpreted as a compliance "access fee" for each category. If multiple types of batteries are sold at the same time (e.g., portable batteries + electric vehicle batteries), separate fees are required for the corresponding categories, and the fees are cumulative.

2) Will I get multiple UIN numbers for registering multiple battery categories?

No. The UIN (Unique Identification Number) is the exclusive "environmental ID" of a company in the French battery recycling system, with only one UIN corresponding to a company. when a new battery category is added to the battery register, there is no need to re-apply for a UIN, but only to add the information of the new category to the existing account, and all the compliant operations are grouped together under the UIN. All compliance operations are grouped under this unique identification, which is convenient for management and declaration.

According to the French Battery Recycling Agency (AFB), the 2026 French EPR battery renewals are required to submit the relevant filing information by September 30, 2025.

05 expositoryTypes of French company registration

Similar to China where there are numerous types of companies, France also has various types of companies such as SARL, SCI, SNC, SA, SAS, GIE and many others. Three of them are more common:

▎ Limited Liability Company (SARL):

One of the most common types of companies, suitable for small or medium-sized businesses, relatively simple and flexible with few restrictions.

▎ Simplified Association of Shareholders (SAS):

More suitable for small and medium-sized enterprises limited by shares, the need for capital verification, do not recommend e-commerce partners to register.

Ltd. (SA):

Suitable for medium and large-sized enterprises company type, suitable for companies with listing plans to register, higher maintenance costs.

If you are a cross-border seller, it is generally recommended that you register - Limited Liability Company (SARL)

✅ Tax policy: there is a tax-free sales degree of about 500,000 euros a year, and the newly registered company will generally not check the tax within 2-3 years. (However, no non-declaration/zero declaration is allowed to avoid closing the store due to tax problems.)

✅ Save money: registering a SARL company can be done without opening a physical bank account and there is no registered capital limit.

✅ Flexibility: Allows customization of corporate structure, management style and shareholders' equity, which can be selected according to business needs.

✅ Annual review: France delays the annual review of newly established companies for one year, and in the second year, you only need to pay for the address.

In addition, SARL recommends that two shareholders are registered, as shareholders with more than 50% shares are subject to a social contribution (commonly known as boss tax) of approximately €1,300 per year, the amount of which varies from year to year.

07  Attention to the subsequent maintenance of the French company registration

After the registration of a French company, even if the operating data is 0, you should handle the maintenance work of the company's VAT tax filing, annual audit (annual account processing), and the filing of the annual financial report according to the regulations. Understand and comply with the relevant French laws and regulations to ensure the legal validity of the company.

1) Types of French company tax returns

Non-operating companies: These companies are usually only required to file zero returns and annual audits. A zero filing means that the company has not generated any income or expenses, but still needs to report them to the tax authorities.

Companies with operations: These companies are required to submit year-end financial statements and file year-end tax returns in addition to annual audits.

In broad terms, French taxes can be categorized as income tax, excise tax, capital tax and local taxes. The current tax rate is 36.6% on the net profit of a company. Businesses that do not make a profit, or make a loss, are only subject to the basic tax rate.

2) Annual review of French companies

In order to ensure the effective existence of a French company, a local accountant must be appointed from January 1 to May 15 of each year to conduct a company audit report.

The annual review of a French company mainly includes: confirming the company's business information, renewing the company's business license, renewing the company's registered address, and renewing the statutory secretarial services.

3) Filing of annual financial reports

At the end of the fiscal year, a French company must appoint a CPA firm to issue annual financial statements and file the company's VAT and Profit Tax (CIT) returns. However, the completion of the returns does not mean that the maintenance is complete, and the annual financial statements must be submitted to the Commercial Court for registration.

In accordance with French commercial law, the annual financial statements must be filed with the Commercial Court within seven months of their preparation.

Therefore, it is recommended that you engage a professional corporate service provider such as us, Enterprise Finance Group, to fully handle your company's financial, tax and contractual issues to improve efficiency and compliance.
